Our Contract

We must receive payment of the whole of the price for the goods you order before your order can dispatched and accepted. Our acceptance of your order brings into existence a legally binding contract between us.

 

Entire Agreement

These terms and conditions, together with our current web site prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you by us. These terms and conditions cannot be varied except in writing. In particular, nothing said by any of our staff should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. We shall have no liability for any such representation being untrue or misleading.

 

Errors in listings

Although every effort has been made to ensure that the information on our listings is correct we cannot guarantee there are no inaccuracies. We will endeavour to correct  anything brought to our attention. Should an item be inadvertently and significantly mis-described and the customers complaint is a reasonable one then the consumer will be entitled to a full refund (including postage costs) on the return of the goods.

 

Price

Prices on the site will be honoured at the time of buying but are subject to change without notice.

 

Liability

If you do not receive the goods you ordered, please advise us as soon as possible in writing at our contact address as soon as possible. We will be unable to trace goods lost in transit if notification is after 14 days from dispatch and we shall have no liability to you. If you notify a problem to us under this condition, our only obligation will be (at our option): to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question in whatever way we choose. We will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to us under this condition and we shall not be liable for any payment to you by way of compensation other than to refund the amount paid by you for the goods in question.

 

All terms, conditions, warranties and representations expressed or implied by statute, applicable local law or otherwise in relation to the goods you order are excluded. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. This does not affect your statutory rights as a consumer.

 

Force Majeure

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

 

Invalidity

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected.

 

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have exclusive jurisdiction to resolve any disputes between us.

 

Use of Trademarks

No right or licence must be intended by the Buyer to be transferred by the Seller for the use of any of the trade names, trademarks, registered marks of, or used by, S.R.Gladson and Son

Fraud

Should we have any suspicion that a transaction may be fraudulent it will be reported to the credit card companies and the authorities and no goods will be dispatched until the situation is clarified.

 

Returns

 

Cancellation

You may exercise your right to cancel your order within 7 working days of receiving your order. If you do decide to cancel, you should put this in writing - either by e-mail, fax or letter. Goods are to be returned to our contact address at your own cost and risk. We shall refund you, within 30 days, the price you paid for any goods returned, PROVIDED THAT such goods are returned by you/collected by us at your own cost and received by us in as new condition. We would ask that if you can try and contact us before an item is shipped this way we will both save time and money.

 

Items Damaged in Transit

If any items were damaged in transit, we ask that you report it to us within 7 working days. If the items are visibly damaged on receipt, you will need to sign the  carrier's delivery note accordingly. Items should be returned in their original packaging complete with all accessories and documentation. Once received back, we'll issue a replacement or full refund to you via your original payment method and reimburse your reasonable return carriage costs.

 

Faulty Items

The majority of the items we sell require a level of understanding and competence in the hobby from users. It is not uncommon and natural for people to mistake their error for one in the product. Therefore in the first case we would ask you to contact us with your problem in the hope that several minutes of advise can save us both some time and effort. Beyond this if an item needs to be returned we require it to be returned with a full description of the fault, and the events before the fault occurred.

 

Items Faulty on Arrival

If your items are faulty on arrival, you have 7 calendar days in which to inform us of the fault. Depending on the situation we will try and find the quickest solution for you. Should the items need to be returned they will need to be in their original packaging complete with all accessories and documentation. Once we have verified the fault, we'll issue a replacement or full refund to you via your original payment method, and for UK customers we will reimburse your reasonable return carriage costs. We test returned items, and if a returned item is found not to be faulty by our technicians we will return the item to you, in this instance you will be liable for the return carriage.

 

Items Faulty in Warranty Period

If any of your purchases develop a fault which is covered by warranty (for example it is not considered a wearable item) then provided your item is within its warranty period, you may be entitled to a warranty repair. In some cases, manufacturers provide a specialist service centre and/or telephone help facilities for your convenience which we recommend you use in order to correct the fault quickly. As many of our products are open to user misuse and abuse it should not be taken as granted that you will be covered under any given warranty, as previously mentioned a lot of our products require a level of understanding and competence in the hobby if we deem you do not have this it may influence any warranty claim.

 

Examples of  items not covered are:

  • Many manufactures will not warrant and engine after it has been run.
  • Pull starters on model two stroke engines are seldom covered.
  • Conrods on model car and helicopter engine, this is due to the ease with which these engine can be shaft run.
  • This list is not exhaustive.

 

We recommend you use an insured method for the return of goods.
